Terms & Conditions
1. Provider and scope
1.1 These Terms govern your use of the CabalSpy Telegram trading bot and the web terminal at app.cabalspy.xyz (together, the "Service"). The Service is provided by the operator named in our Impressum ("we", "us").
1.2 By using the Service you accept these Terms. Our privacy policy explains how we process personal data. Deviating terms of users do not apply.
1.3 These Terms are available in English and can be viewed, saved and printed on this page at any time.
2. What the Service does
2.1 The Service is a software tool for trading crypto tokens on the Solana and BNB Smart Chain blockchains. It lets you (a) receive market information and signals, such as token activity of tracked wallets ("KOL" and "smart money" clusters), token calls (Good Token, Moderate, Gamble), a live feed, charts, a heatmap, statistics and leaderboards; (b) configure bots that buy and sell automatically according to rules you set, such as signal thresholds, buy amount, take profit, stop loss, DCA, limit orders, time-based and migration sells; (c) trade manually, including quick buy and sell; (d) simulate strategies without real funds ("paper trading") and copy the settings of other bots; and (e) run automated safety checks on tokens.
2.2 Trades are executed on-chain through third-party swap aggregators, currently Jupiter on Solana and KyberSwap on BNB Smart Chain. We do not operate an exchange, order book or liquidity pool and are never your counterparty.
2.3 Market data, signals and safety data are provided by third parties, currently including CabalSpy, Mobula, RugCheck and GoPlus. We may change providers and features as long as the core purpose of the Service remains available to you.
3. Eligibility and access
3.1 You must be at least 18 years old and have full legal capacity. You use the Service for your own account and not on behalf of third parties.
3.2 You may not use the Service if you are resident in, located in or a national of a country or region subject to comprehensive EU, UN, US or UK sanctions, if you are listed on a sanctions list, or if using the Service is unlawful where you are.
3.3 Live trading is available to every user. Access is personal and may not be transferred, sold or shared. We may limit, suspend or refuse access for individual accounts at any time, in particular in case of misuse.
3.4 Your account is linked to your Telegram account. Keep your Telegram account and devices secure. We are not liable for actions taken through your Telegram account by third parties unless we are at fault.
4. Trading wallets and keys
4.1 For live trading, the Service creates a dedicated trading wallet for you on each supported chain, or you import one. The private key is stored encrypted on our servers so that the bot can sign transactions on your instructions. Assets in the trading wallet are your assets.
4.2 You can export your private key and withdraw your assets at any time, except during technical disruptions or where a legal obligation prevents it. Anyone who obtains an exported key has full control over the wallet - keep it secret. We will never ask you for it.
4.3 Only keep amounts in the trading wallet that you can afford to lose. We may set maximum balances and limits per trade, per hour, for open positions and for daily losses. Current limits are shown in the bot and the terminal.
4.4 If you delete a wallet in the Service without exporting its key or withdrawing its funds first, the assets may become permanently inaccessible.
4.5 Blockchain transactions cannot be reversed. You are solely responsible for the correctness of withdrawal and payout addresses you enter. We cannot recover assets sent to a wrong or incompatible address and are not liable for them.
5. Automated trading and your decisions
5.1 Bots act only on the rules and amounts you configure. By enabling live trading you instruct the Service to buy and sell automatically with real funds from your trading wallet whenever your rules are met. Before the first activation you confirm a risk notice. You can stop all trading at any time with /panic or by switching live trading off.
5.2 Switching live trading off stops new buys. Open positions keep their take-profit and stop-loss rules until you sell them or use the panic stop.
5.3 Take profit, stop loss and similar orders are not guaranteed. In fast markets or with low liquidity, sells can execute far below your limit, only partly or not at all, and buys can fail or execute at a worse price than expected.
5.4 Paper trading is a simulation. Paper results, copy-bot rankings, leaderboards, call analyses and win rates are based on past or simulated data and do not predict live results.
6. No investment advice
6.1 We provide software and information, not investment, financial, legal or tax advice. Signals, token calls, prediction calls (statistical model outputs), safety scores, statistics and bot templates are not recommendations or offers to buy or sell any asset.
6.2 Safety checks reduce risk but do not remove it. A token that passes all checks can still be a scam or lose all its value.
6.3 You make all trading decisions yourself and bear all resulting gains and losses.
7. Risks
Trading crypto tokens, in particular newly launched tokens, is extremely risky. Risks include: total loss within seconds; rug pulls, honeypots, hidden token taxes and insider selling; extreme volatility, slippage, price impact and missing liquidity; failed or delayed transactions that still cost network fees; front-running and sandwich attacks (MEV), even with MEV protection; smart-contract bugs, network congestion or outages; errors, delays or downtime of swap routers, RPC nodes, data providers, Telegram or our servers, including delayed or incorrect data; theft if your device, Telegram account or exported key is compromised; and regulatory changes. Only use funds you can afford to lose completely.
8. Fees and cashback
We keep our pricing simple: every fee we charge is listed in this section, and there are no hidden fees. Fees are deducted automatically in the native currency of the chain (SOL or BNB) and appear in your trade messages. Half of the trade fee, rent and profit fee comes back to you as cashback.
8.1 Platform fee (Solana and BNB Smart Chain): 1% of the buy amount on every buy and 1% of the proceeds on every sell. If a transfer is temporarily not possible, the fee is recorded as outstanding and collected later, at the latest with your next withdrawal.
8.2 Trade fee (Solana): a fixed fee per buy, including follow-up buys such as DCA, taken from the buy amount (the total you spend). The minimum buy is 0.02 SOL.
| under 0.05 SOL | 0.0025 SOL |
| 0.05 to under 0.10 SOL | 0.005 SOL |
| 0.10 to under 0.25 SOL | 0.0075 SOL |
| 0.25 to under 0.50 SOL | 0.0125 SOL |
| 0.50 to under 1.00 SOL | 0.025 SOL |
| 1.00 SOL or more | 0.05 SOL |
8.3 Token account rent (Solana): when you buy a token, Solana requires a small deposit ("rent", currently about 0.002 SOL) for the token account. When the bot fully sells the position and closes the account, the rent is paid to us. The network fee for closing is paid from your wallet.
8.4 Profit fee (Solana): if a single sell returns more than +100% on the cost of the tokens sold, 2.5% of the profit of that sell. Sells up to +100% carry no profit fee.
8.4a Copy bot fee: if you trade live with a bot you copied from another user, 0.25% of every buy and every sell is paid to the creator of that bot. Creators can claim it on the Rewards page at any time; unclaimed copy bot fees expire on 31 December (UTC) of the year in which they became claimable. Paper trading and your own bots carry no copy bot fee.
8.4b Alpha fee: users can report a Solana token as "alpha" if they hold it in their trading wallet worth at least 0.2 SOL. While at least one report is active, every live buy and sell of that token by other users carries an alpha fee of 0.1%, paid to the active reporters in equal shares. Reporters pay no alpha fee on their own trades. A report ends with the reporter's first sell of that token, including partial sells and sells outside the Service. Reporters claim alpha fees on the Rewards page; unclaimed alpha fees expire on 31 December (UTC) of the year in which they became claimable.
8.4c Referral fee: every user gets a personal invite link (Telegram bot and terminal, on the Rewards page). If you sign up for the first time through another user's invite link, 0.25% of every live buy and every live sell you make on Solana is paid to that user, for as long as you use the Service. The invite is recorded only at your first sign-up and cannot be added to an existing account later; your own invite link cannot be used. Paper trading carries no referral fee. Referral fees are collected through our revenue wallet and credited to the referrer, who claims them on the Rewards page; unclaimed referral fees expire on 31 December (UTC) of the year in which they became claimable.
8.5 Network costs: network fees, priority fees, MEV-protection tips and gas are paid to the blockchain and its validators, not to us, and depend on your settings.
8.6 Cashback: 50% of every trade fee, rent and profit fee you pay is credited to you as cashback once the fee has been received. (a) 75% of it can be claimed at any time; (b) 25% is unlocked every Monday at 12:00 UTC; (c) the platform fee (8.1) earns no cashback; (d) cashback is paid in SOL to your trading wallet or to another Solana wallet you enter on the Rewards page - the network fee of the payout is deducted from the amount, and you are responsible for entering a correct address (see 4.5); (e) a minimum payout amount applies as shown on the Rewards page; (f) unclaimed cashback expires on 31 December (UTC) of the year in which it became claimable; (g) cashback cannot be transferred to other users.
8.7 Changes: we may change fees or the cashback programme for the future and will inform you at least 30 days in advance in the bot or the terminal. Changes never apply to trades made before they take effect. If you do not agree, you may stop using the Service and withdraw your assets free of charge. We may waive or reduce fees for individual users or promotions.
9. Taxes
You are solely responsible for determining, reporting and paying taxes on your trades and cashback. Trade histories in the Service are provided for convenience and are not tax documents.
10. Availability and changes
10.1 We aim for high availability but do not guarantee uninterrupted or error-free operation. Maintenance, updates, overload, attacks or third-party outages can interrupt the Service, and automated orders (including stop losses) may not be executed during an interruption.
10.2 We may modify, add or discontinue features if this is reasonable for you. We will give reasonable notice before discontinuing the Service as a whole so that you can withdraw your assets.
11. Prohibited use
You may not use the Service for market manipulation (e.g. wash trading, pump-and-dump schemes, spoofing), fraud, money laundering, terrorist financing or sanctions evasion; reverse-engineer, overload, scrape or attack the Service; bypass limits, access controls or fees; resell or share access; or use multiple accounts to abuse cashback or invitations.
12. Suspension and termination
12.1 You may stop using the Service at any time. Before deleting your account or wallet, withdraw your assets or export your key.
12.2 We may suspend or terminate your access with reasonable notice, or without notice for good cause, in particular for breaches of Sections 3 or 11, legal or regulatory requirements, or security risks.
12.3 After termination you can still withdraw your assets or export your key unless a legal obligation prevents it. Cashback that is claimable at termination remains claimable until it expires, unless termination was due to abuse of the cashback programme.
13. Liability
13.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.
13.2 For slight negligence we are only liable for breaches of essential contractual obligations - obligations whose fulfilment makes the proper performance of the contract possible and on which you may regularly rely - and limited to the typical damage foreseeable when the contract was concluded.
13.3 Otherwise, liability for slight negligence is excluded. Subject to 13.1 and 13.2, we are in particular not liable for trading losses caused by market movements or your settings, losses caused by third-party services (blockchains, swap routers, data providers, Telegram), or losses caused by the loss or disclosure of your exported key, your Telegram account or a wrong address you entered.
13.4 These limitations also apply in favour of our employees and agents.
14. Right of withdrawal for consumers
14.1 If you are a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The period starts on the day the contract is concluded. To exercise it, send us a clear statement (e.g. by email to the contact address in our Impressum). You may use the model form below but do not have to. Sending your statement before the period expires is sufficient.
14.2 Effects: if you withdraw, we will refund all payments received from you without undue delay and at the latest within 14 days. If you asked us to start the service during the withdrawal period, you pay a reasonable amount for the services provided until the withdrawal. Trades already executed on the blockchain cannot be reversed.
14.3 Your right of withdrawal expires early once we have fully performed the service, if you expressly agreed that we start before the end of the withdrawal period and acknowledged that you lose your right of withdrawal on full performance. Individual token trades whose price depends on fluctuations in the financial market are not subject to withdrawal.
14.4 Model withdrawal form: "To [provider], the contact address in our Impressum: I hereby withdraw from my contract for the provision of the following service: ___. Ordered on ___. Name and Telegram username: ___. Date: ___."
15. Changes to these Terms
We may change these Terms for valid reasons, such as new features, legal changes or changes to third-party services. We will inform you in the bot or on the website at least 30 days before changes take effect and ask for your consent where required by law. If you do not agree, you may terminate before the changes take effect and withdraw your assets.
16. Governing law and disputes
16.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. As a consumer you keep the protection of the mandatory consumer law of the country where you habitually reside.
16.2 If you are a merchant, a legal entity under public law or have no general place of jurisdiction in the EU, the courts at the provider's registered seat have exclusive jurisdiction.
16.3 We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. Please contact us directly with any complaint.
17. Final provisions
17.1 If any provision of these Terms is invalid, the remaining provisions stay in effect and the statutory provisions apply instead.
17.2 Contact: the contact address in our Impressum.
